WARRANTY POLICY – EUROPEAN UNION

This Warranty Policy applies to Products purchased via the TEQERS / TEQBALL EU Webshop and marketed within the European Union.

Capitalized terms used in this Warranty Policy have the meaning defined in the General Terms & Conditions. This Warranty Policy shall be interpreted and applied together with the General Terms & Conditions.


I. SCOPE OF APPLICATION

This Warranty Policy applies if:

  • the Customer qualifies as a Consumer, meaning a natural person acting for purposes outside their trade, business or profession; and
  • the Consumer has their habitual residence within the European Union, presumed based on the delivery address provided at checkout.

If a Product is purchased through an authorized Distributor partner, local mandatory consumer protection rules applicable in the Distributor’s country may apply. If such rules provide stronger consumer rights, those shall prevail.

This Warranty Policy does not limit or exclude any mandatory rights granted to Consumers under applicable EU or national consumer protection laws.


II. LEGAL GUARANTEE OF CONFORMITY (EU CONSUMER WARRANTY)

1. What is covered?

The Seller is liable for any lack of conformity of the Product that exists at the time of delivery.

A Product is considered non-conforming if it:

  • does not correspond to the description, type, quantity or quality agreed;
  • is not fit for its intended or usual purpose;
  • does not possess the durability, functionality or performance reasonably expected.

2. Warranty period and burden of proof

  • The Consumer may exercise warranty rights within two (2) years from delivery of the Product.
  • If the lack of conformity becomes apparent within one (1) year from delivery, it is presumed to have existed at the time of delivery, unless proven otherwise by the Seller.
  • After one year, the Consumer may be required to prove that the defect existed at the time of delivery.

3. What is NOT covered?

The warranty does not cover defects resulting from:

  • normal wear and tear;
  • improper or non-intended use;
  • failure to follow installation, usage or maintenance instructions;
  • lack of necessary maintenance communicated by the Seller or manufacturer.

Extreme environmental exposure exclusion

If a TEQ™ table is used or stored in an environment where it is continuously exposed to saltwater vapor or permanent moisture, corrosion or discoloration caused by such conditions is excluded.

The warranty also does not cover damage caused by external factors, including but not limited to:

  • mechanical damage to surface coatings,
  • corrosive substances,
  • resin, bird droppings,
  • lightning, storm, flood, fire or other force majeure events.

III. CONSUMER REMEDIES

In the event of a lack of conformity, the Consumer is entitled to the following remedies, in the order below:

1. Repair or replacement

The Consumer may request repair or replacement free of charge.

The Seller may refuse repair or replacement if:

  • it is impossible, or
  • it would impose disproportionate costs compared to the alternative remedy.

All costs related to repair or replacement (including shipping, if applicable) are borne by the Seller.


2. Price reduction or contract termination

The Consumer may request:

  • a proportionate price reduction, or
  • termination of the sales contract with a full refund,

if:

  • repair or replacement is not possible,
  • repair or replacement was not completed within a reasonable time,
  • the defect persists despite repair attempts,
  • the defect is of such seriousness that immediate price reduction or termination is justified.

Termination is not available for minor defects.


IV. HOW TO SUBMIT A WARRANTY CLAIM

To exercise warranty rights, the Consumer must:

  1. Submit the warranty claim without undue delay, and no later than two (2) months after discovering the defect.
  2. Submit the claim via one of the following channels:
  3. Attach:
    • proof of purchase (invoice or receipt);
    • photos and/or videos clearly showing the defect.
  4. If more than one year has passed since delivery, provide evidence that the defect existed at the time of delivery.
  5. If necessary, make the Product available for inspection, return, or carrier pickup as instructed by the Seller.

Claims submitted through other channels (e.g. social media, forums) do not qualify as valid warranty notifications.
